The Human Right to Nationality: European and Latin American Perspective
A pesar de que la consideración de la nacionalidad como derecho humano
no es una cuestión del todo pacífica, lo que resulta obvio es que, tanto los
instrumentos internacionales de protección de los derechos humanos, como los propios tribunales encargados de controlar su efectiva aplicación, están limitando la competencia exclusiva de los Estados en esta materia. Aun cuando se reconozca el derecho de los Estados-nación a proteger su forma de vida, y el derecho de los nacionales, como pueblo soberano y constituyente, a establecer restricciones para el acceso a la ciudadanía a los extranjeros, estos derechos no son ilimitados.Although the consideration of nationality as a human right is not a matter

CIUDADANÍA, FAMILIA Y MUJER INMIGRANTE VÍCTIMA DE VIOLENCIA DE GÉNERO
The major social, legal and judicial sensitization on the need to eradicate genderbased violence demands a suitable and effective response from all Public Institutions to safeguard the rights of the women. The principal aim of this article is to highlight the legislative solution given to this problem in relation with immigrant women (third-country nationals). Spanish and EC lawmakers have set out rules relating to gender-based violence for three groups of women: a) Married women or registered partners of European Union, EEE, Swiss or Spanish citizens; b) Women married to third-country nationals; c) Women who are in Spain, married or not, in an irregular situation. The legislation analyzed in this paper regulates only the administrative situation to which women can accede when they are the victims of gender-based violence. That is to say, what types of authorizations can be granted and what possible “benefits” can be obtained, but only in the documentary area. Neither the penal or civil response to gender-based violence is analyzed.La mayor sensibilización social, legal y judicial sobre la necesidad de erradicar la violencia de género en el ámbito doméstico demanda de todas las instituciones públicas una respuesta adecuada y efi caz para salvaguardar los derechos de las mujeres. Este artículo tiene como objetivo fundamental poner de relieve la solución legislativa que se ha dado a este problema en relación con las mujeres nacionales de terceros Estados. Los legisladores comunitario y español han incluido preceptos relativos a la violencia de género en el ámbito doméstico para tres grupos de mujeres: a) mujeres casadas o que son pareja registrada de nacionales comunitarios, E.E.E., suizos o españoles; b) mujeres casadas con nacionales de terceros Estados; c) mujeres que se encuentran en España, casadas o no, en situación irregular. La legislación que se analiza sólo regula la situación jurídico-administrativa a la que es factible acceder si se es víctima de esta clase de violencia. Es decir, qué tipos de autorizaciones pueden concederse y qué posibles “beneficios” se pueden obtener, pero solo en el plano documental. No se estudia, por tanto, ni la respuesta penal, ni la respuesta civil a la violencia de género

The Right to Family Life. A Difficult Path from Morocco
Abstract: The right to family life and family intimacy are key in any migration policy, but the "fear" of family reunification as gateway and their potential multiplier effect has been, and continues to be, a constant in contemporary international migration management. However, it should be noted, that the object of this work is not to analyze, in general, the regulation of the family reunification at international or european level even in the Spanish one. The aim is to focus the study on a very specific issue, with the purpose of being a guide for those Moroccans who want to come to Spain as spouses or partners of a Spanish or another nationals of thirds States. The journey is long, as it will be analyzed, and is fraught with difficulties. The marriage with a Spanish is no longer synonymous with safe and easy entry. And not to say if instead of a Spanish national your union is with other national of third State. The obstacles are incessant and reunification tired complicated.

Derecho a la vida en familia. Un difícil camino desde Marruecos
Resumen: El derecho a la vida en familia y a la intimidad familiar son claves en cualquier política migratoria, pero el «miedo» a la reagrupación familiar como vía de entrada y su potencial efecto multiplicador ha sido, y sigue siendo, una constante en la gestión contemporánea de las migraciones internacionales. No obstante, hay que precisar, que el objeto de este trabajo no es analizar, en general, la regulación de la reagrupación familiar en el ámbito internacional, o comunitario, ni siquiera en el español. El objetivo es centrar el estudio en una cuestión muy concreta, con la finalidad de que sea una guía para aquellos/as nacionales marroquíes que quieren venir a España como cónyuges o parejas de un/a español/a, u otro nacional de tercer Estado. El trayecto es largo, como se analizará, y está plagado de dificultades. La unión con un español/a ya no es sinónimo de entrada fácil y segura. Y no digamos si en lugar de un español/a su unión es con otro nacional de tercer Estado. Las trabas son incesantes y la reagrupación harto complicada.

Résumé : Le droit à la vie en famille et à l’intimité familiale sont des facteurs clés dans toute politique migratoire, mais la « peur » du regroupement familial comme voie d’entrée et son effet potentiel multiplicateur a été et continue d’être une constante dans la gestion actuelle des migrations internationales. Cependant, il nous faut préciser que l’objet de ce travail ne consiste pas à analyser, en général, la régulation du regroupement familial dans le domaine international, ou communautaire, ni même espagnol. L’objectif est d’axer notre étude sur une question très concrète, dans le but que ce soit un guide pour les ressortissants marocains qui désirent venir en Espagne en tant que conjoint ou partenaire d’un/e espagnol/e, ou d’un/e autre ressortissant/e d’un Etat tiers. Nous verrons que le parcours est long et truffé d’obstacles. L’union avec un/e espagnol/e n’est plus synonyme d’entrée sûre et facile. Et ne parlons pas des cas où, si au lieu d’une union avec un espagnol, il s’agit d’un citoyen d’un Etat tiers ! Les obstacles sont multiples et le regroupement est un parcours plus que difficile.

Second GHEP-ISFG exercise for DVI: “DNA-led” victims’ identification in a simulated air crash
The Spanish and Portuguese-Speaking Working Group of the International Society for Forensic Genetics (GHEP-ISFG) has organized a second collaborative exercise on a simulated case of Disaster Victim Identification (DVI), with the participation of eighteen laboratories. The exercise focused on the analysis of a simulated plane crash case of medium-size resulting in 66 victims with varying degrees of fragmentation of the bodies (with commingled remains). As an additional difficulty, this second exercise included 21 related victims belonging to 6 families among the 66 missings to be identified. A total number of 228 post-mortem samples were represented with aSTR and mtDNA profiles, with a proportion of partial aSTR profiles simulating charred remains. To perform the exercise, participants were provided with aSTR and mtDNA data of 51 reference pedigrees —some of which deficient—including 128 donors for identification purposes. The exercise consisted firstly in the comparison of the post-mortem genetic profiles in order to re-associate fragmented remains to the same individual and secondly in the identification of the re-associated remains by comparing aSTR and mtDNA profiles with reference pedigrees using pre-established thresholds to report a positive identification. Regarding the results of the post-mortem samples re-associations, only a small number of discrepancies among participants were detected, all of which were from just a few labs. However, in the identification process by kinship analysis with family references, there were more discrepancies in comparison to the correct results. The identification results of single victims yielded fewer problems than the identification of multiple related victims within the same family groups. Several reasons for the discrepant results were detected: a) the identity/non-identity hypotheses were sometimes wrongly expressed in the likelihood ratio calculations, b) some laboratories failed to use all family references to report the DNA match, c) In families with several related victims, some laboratories firstly identified some victims and then unnecessarily used their genetic information to identify the remaining victims within the family, d) some laboratories did not correctly use “prior odds” values for the Bayesian treatment of the episode for both post-mortem/post-mortem re-associations as well as the ante-mortem/post-mortem comparisons to evaluate the probability of identity. For some of the above reasons, certain laboratories failed to identify some victims. This simulated “DNA-led” identification exercise may help forensic genetic laboratories to gain experience and expertize for DVI or MPI in using genetic data and comparing their own results with the ones in this collaborative exercise.This research did not receive any specific grant from funding agencies in the public, commercial, or not-for-profit sectors.Peer reviewe
